The expensive mistakes do not look like mistakes for four months. Demos land, the deck stays green — then integration starts, the engineers you interviewed were never assigned, and nothing says who owns the repository.
Choosing a software development company in India is a risk-allocation exercise wearing a shortlist's clothes. Cost overrun, slipped dates and ambiguously owned IP are visible before you sign. We are one of those vendors; these are the checks we would want run on us.
Why India Remains a Top Destination for Outsourced Software Development
India's technology sector should cross $315 billion in FY26, employing roughly 6 million people — about $52,000 of revenue per head. IT outsourcing India is no bargain bin, and a quote far below that tells you who will write your code.
The depth cuts both ways. The country also hosts 2,117 global capability centres recruiting from your offshore development team's pool. Six million engineers means the gap between the best supplier and the worst is enormous — and both have the same website.
How to Evaluate a Software Development Company in India: Portfolio, Domain Expertise & Certifications
Portfolios are curated. Ask about the parts that were not. Ask what broke in production: a team that has run a system answers in seconds, one that shipped and left describes features again. Ask to see code, too — what looks finished but is not surfaces in month six.
Domain expertise is a claim about incidents, not industries. "We've worked in fintech" is a category. "We've handled a reconciliation break during a settlement window" is experience.
Certifications certify a management system, not your project. ISO/IEC 27001 covers an information security management system within a declared scope, so read the scope statement — one covering a single delivery centre says nothing about your team — and verify the body on IAF CertSearch.
Engagement Models to Consider Before You Hire a Software Development Company
| Fixed price | Dedicated development team | Staff augmentation | |
|---|---|---|---|
| Best when | Scope is settled | Roadmap moving | Leadership in place, capacity short |
| Scope risk sits with | The vendor | You | You |
| Typical failure | Fighting over "done" | Drift, no owner | Skilled people, no architect |
Fixed price transfers risk to the vendor, and the vendor prices that transfer. A dedicated development team costs less per change, but only if someone on your side owns the roadmap — full breakdown in choosing an engagement model.
Time Zone, Communication, and IP-Protection Concerns Addressed
India runs on UTC+5:30 and does not observe daylight saving, so the overlap window moves twice a year on your side, not theirs.
London and Berlin get half a working day free. New York and San Francisco get none: US overlap must be bought with an India-side shift to 23:00 IST — a contract commitment, not a sales-call assurance.
On IP, one clause matters more than the NDA. Under India's Copyright Act an assignment must specify duration and territory: if the period is silent it is deemed five years, and if the territory is silent it is presumed to extend within India only. Boilerplate with neither leaves you five years of Indian rights to software you paid to own.
India has no EU adequacy decision, so EU transfers need Standard Contractual Clauses plus the processor terms GDPR Article 28 requires. For Indian personal data, the DPDP Act applies too.
Case Snapshot: How an IIT-Alumni-Led Team Like Vidyayatan Structures Delivery
Work opens with a paid discovery of two to four weeks, ending in an architecture note, a risk register and a revised estimate. Delivery runs in two-week sprints against a client-owned backlog, each ending in a demo of working software rather than a slide, with review, tests and a QA gate before production. Every engagement starts from the same project kickoff checklist.
Powering Businesses Through Smarter Technology
The same structure, across eight production systems in very different industries:
- BharatPe — payment microservices, merchant management and automated chargeback operations; splitting the monolith without pausing traffic.
- Habuild — live yoga sessions with trainer and member management, payments and engagement; what scaling it took.
- Srichakra Reclamations — recycling operations end to end: supplier onboarding, KYC, field tracking, shipments, gate passes and finance.
- T-FOMS, Telangana Forest Department — offline-first offence reporting for field officers, with case tracking, evidence management and command-centre analytics.
- Home Review — tenant verification, inspections and lease management for property managers.
- Programming Pathshala — online classrooms, mentor bookings, automated coding evaluation, payments and referrals.
- Labour Link — workforce, security and compliance management with live GPS tracking and role-based dashboards.
- Innowell — industrial IoT and site mapping: workstation telemetry, energy analytics, inventory and sustainability tracking.
The range is the point. A forest officer with no signal and a payments platform at national scale need different architectures and the same discipline.
A Due-Diligence Checklist Before You Hire a Software Development Company in India
Run this software outsourcing checklist on every shortlisted custom software development partner.
- Two references you chose, including one project that went badly.
- Named engineers, with CVs and notice before anyone is swapped.
- The ISO certificate itself — scope read, body verified.
- The IP assignment clause, stating duration and territory.
- A data processing agreement, with SCCs where EU/UK data leaves.
- A paid pilot: one real slice of work, four to six weeks.
- Overlap hours as a commitment, naming who works the late shift.
- The exit clause — notice, handover, transition cost — and who holds root credentials.
Common questions
Is charging for a pilot a red flag? The opposite. Free work is either a subsidised sales process or staffed with whoever is spare. Four to six weeks of paid work is the cheapest diligence available.
Is India cheaper than nearshore options? Usually on rate, not on total. Nearshore vs offshore development buys overlap hours at a higher rate — the comparison settles once you price the meetings you need.
What if they won't give references we choose? Treat the refusal as the answer. A confident supplier lets you pick from the client list, including a project that went badly.
Do we need a lawyer for the IP clause? For anything you intend to own, yes. Those defaults are easy to miss, and an hour of counsel beats a disputed assignment.
When is a company too small for all this? Below roughly $30,000 of work most of it is disproportionate — run a pilot, keep the contract short, hold the credentials. Same judgement as whether to build at all.
